Aceasta este concluzia Curţii de Apel Bucureşti, care a decis menţinerea mandatului european de arestare emis pe numele acestuia şi cererea autorităţilor din România de dare în urmărire internaţională.
Decizia a fost luată în luna august, după ce Tribunalul Bucuresti revocase iniţial mandatul de arestare emis în lipsă.
Elan Schwartzenberg este judecat pentru că ar fi intermediat o mită de 175.000 de euro dată de afaceristul israelian Avraham Morgenstern fostului primar al oraşului Constanţa, Radu Mazăre. Decizia Tribunalului Bucuresti, de revocare iniţială a mandatului de arestare, a venit în contextul în care Înalta Curte i-a achitat, în faza de fond a procesului, pe Morgenstern şi Mazăre.
Această sentinţă penală „nici nu este definitivă şi nici nu este motivată”, explică Curtea de Apel Bucuresti.
Magistraţii au arătat că Elan Schwartzenberg continuă să evite organele judiciare române, fiind dat în urmărire internatională, şi se sustrage de la procesul de la Bucuresti.
„Periculozitatea sa, aşadar, rezultă nu numai din activitatea infracţională reţinută în sarcina sa, prin suma mare de bani pe care a intermediat-o prin transferare, raportat la nivelul de trai al unui cetăţean român obişnuit, dar şi din imprejurarea că nu înţelege să se afle la dispoziţia organelor judiciare române şi să execute măsurile dispuse de acestea.
Mai apreciază că, în continuare, măsura preventivă este proporţională cu gravitatea acuzaţiei si este necesară pentru o bună desfăşurare a procesului penal”, a mai motivat Curtea de Apel Bucuresti.
Elan Schwartzenberg a fost dat în urmărire naţională, în anul 2016, poza acestuia apărând pe site-ul Poliţiei la persoane urmărite.
